1.Discussions on this issue have centred on a room document first presented by the delegation of Canada at the April 2006 meeting of the Committee. An updated Chairman's summary taking into account the informal discussion was made available on 11 January 2007 in an informal document.

2.After three rounds of discussions, it appears that delegations share the view that the schedules emanating from the current negotiations must not contain any rollbacks, unless the procedure in Article XXI has been followed. However, delegations hold different views on the desirability of developing language in the legal instrument incorporating the new commitments to the effect that (i) previous schedules would constitute a source for interpreting commitments in the new consolidated schedules, and (ii) unless the procedures of Article XXI had been duly followed, a Member's commitment in its new consolidated schedule could not accord or be construed to accord treatment less favourable than that provided under that Member's previous schedule.
