Abstract
In the case “UNITED STATES-measures relating to shrimp from Thailand”, Thailand challenged the use of zeroing in the antidumping investigation, and the application of the EBR to subject shrimp from Thailand because those measures were inconsistent with the Anti-Dumping Agreement. The following content is based on the WTO dispute settlement (DS343), and will discuss the findings and conclusions in respect to the Panel Report and Appellate Body Report.

Background
On February 1, 2005, the U.S. Department of Commerce (“DOC”) published a final determination of investigation and an anti-dumping duty order imposing definitive anti-dumping duties on imports of certain frozen warmwater shrimp from Thailand. The dispute concerned measures using “zeroing” in the anti-dumping investigation and the “enhanced continuous bond requirement” (“EBR”) for goods subject to anti-dumping and countervailing duties.
