Subject: The exportation of bicycles, screws, and solar products handled by enterprises in the Free Trade Zones and destined for the EU should be approved by the Ministry of Economic Affairs (MOEA). This will take effect as of August 26, 2015.
Legal basis: Paragraph 12, Section 1, Article 16 of the Act for the Establishment and Management of Free Trade Zones
I. This action is taken in order to prevent products made in China from having access to Free Trade Zones for transshipment and being falsely declared as products made in Taiwan, thereby circumventing EU anti-dumping duties and countervailing duties imposed on products made in China, and thus causing the EU to launch anti-circumvention investigations on similar products made in Taiwan, which affect the rights of Taiwanese enterprises. For exportation of bicycles, screws and solar products (for description of products, see Appendix 1) by enterprises in Free Trade Zones and destined for the EU, the said enterprises should obtain in advance a “Special Goods Export Permit for Enterprises in Free Trade Zones” issued by the Ministry of Economic Affairs (for application and filing details, see Appendix 2). The application of the aforementioned export permit shall adhere to the following provisions:
A. The export permit will be valid for 30 days from the day of issue, and may be used separately for consecutive batches of exports.
B. The “Description of Commodities” column on the application form should be filled in item-by-item and include the commodity’s “country of origin.” In the “Required Document Ref. No.” column, the commodity’s origin declaration number must be indicated, and a copy of the Declaration should be attached for inspection.
C. The application can be submitted through the E-Import/Export Permit section on the Bureau of Foreign Trade’s website (http://www.trade.gov.tw/).The “Import or Export Permit No.” and “Import or Export Permit Item No.” columns on the Declaration of Exports for the aforementioned 3 types of products from the Free Trade Zones should indicate the issuing numbers and items on the “Special Goods Export Permit for Enterprises in Free Trade Zones” and include the country of origin item-by-item.
