The Chairman recalled that the Council initiated the review under Article 9 of the TRIMs Agreement in October 1999. Members had had as a basis for their discussion a background study jointly produced by the WTO and UNCTAD Secretariats on trade-related measures and other performance requirements (G/C/W/307 and Add.1). In addition, the Council had received a new communication from Brazil and India concerning the review of the TRIMs Agreement, which had been circulated in document G/C/W/428.
